INTRODUCTION
We know the following information is lengthy, but if you will take the time
to read it carefully and completely, it will help to insure your timely receipt
of benefits.
This information is designed to provide a concise reference for answers to
frequently asked questions. Every effort has been made to verify the accuracy
of all the information contained herein.
An employee’s rights and benefits to which they are entitled are determined
solely by the National Agreement and the Supplemental Agreements. Those plans
or agreements are controlling in the event of any inconsistency between them
and the information contained herein. Absent an express delegation of authority
from the GM Board of Directors, no one has the authority to commit the Corporation
to any benefit or benefit provision not provided for under the written terms
of the benefit program, or to change the eligibility criteria or any other
provisions of such programs.
PLEASE READ CAREFULLY!
STATE UNEMPLOYMENT COMPENSATION (U/C)
The following is an outline of the State process for all employees.
1. The Plant Employment Department will notify the State on June 7, 2005,
about the employees on layoff.
2. You will file for your weekly U/C benefits by telephone or Internet for
each week you are on a temporary layoff.
a. REMEMBER: DO NOT FILE YOUR initial U/C claim or reopen an existing claim
with the Call Center or on the Internet website. Hint: If you talk to a live
person, you are talking to the Call Center. DO NOT FILE YOUR CLAIM WITH THE
CALL CENTER. You must use the automated “INTERACTIVE VOICE RESPONSE” (IVR)
to file your claim. Refer to Paragraph 10 below. Follow the instructions below.
3. After your initial claim has been established, a monetary determination
will be mailed listing your weekly benefit amount, maximum benefit amount,
and total amount of benefits for the current benefit year. If you have questions
about this determination, contact Mike Hadlock at 733-6657. Please notify Mike
Hadlock, 733-6657, for instructions if you are “Monetary Ineligible”.
If you are “Monetary Eligible”, you will be required to call the
State IVR System each week, as previously done. If a layoff week reopens an
existing claim, no notice will be sent.
4. A few of our members have already established a waiting period, therefore
this week will be a payable State benefit. Most of you will have to establish
a waiting period and, if you qualify for benefits, the first week for which
you call in will establish a non-payable week, waiting period for the benefit
year. If you do not call in for the week, your waiting period will not be established.
No benefits can be paid until this waiting period week has been served. However,
SUBenefits will pay. Remember, you must still call U/C to file a claim.
5. The GM week is from Monday through Sunday. The State week is from Sunday
through Saturday. NO CLAIM MAY BE FILED BEFORE THE STATE WEEK ENDS. This means
your weekly claim must be called in after midnight on Saturday of the week
of layoff. Filing on Sundays, June 12, 19 and 26, is highly recommended for
the State’s weeks ending dates of Saturday, June 11, 18 and 25.
6. If you are unable to complete your claim call on Sunday due to the increased
claims load at that time, you will be able to file at any time Monday through
Saturday.
7. If your address has changed or changes during the down time, you must change
it at the plant or your U/C checks, if issued, will be mailed to the wrong
address. In addition to advising the plant, please contact Mike Hadlock, 733-6657,
so he can do a follow-up with the U/C office. U/C checks are not forwarded
by the Postal Service.
8. Claims must be filed within fourteen (14) days of the week-ending date.
If they are not filed within fourteen (14) days after the week has ended, the
claim is considered untimely and will NOT be paid unless good cause has been
shown for the delay.
9. SPECIAL NOTICE TO EMPLOYEES THAT REFUSE AN OFFER TO WORK UNDER THE CONTRACT:
If you have a right to refuse an offer of work under contractual language (e.g.
inverse seniority, special agreements between Union and Management, etc.),
even though you might be charged on the equalization chart, you do not need
to report this event as a refusal of work to the State U/C. You will answer
NO to the question “Did you refuse work during the week you are claiming
benefits?” on the IVR System.
10. To file your weekly claim on the Interactive Voice Response (IVR) System:

The IVR System is available 24 hours a day, 7 days a week, or you may now file
your claim for U/C benefits or file for continued weeks on the Internet at
www.unemployment.ok.gov. You may also use the Internet to check if your weekly
check has been mailed.
11. REMEMBER, the IVR System will give you step-by-step instructions for each
question and you will answer “YES” by entering “1" or “NO” by
entering “9".
FOR NEW CLAIMS, on your first call, you will be required to establish a four-digit
PIN number that you will make up. This is your personal, confidential number
and electronic signature. DO NOT give this number to anyone as you will be
held accountable for any payments made in error if others use your PIN.
Those that established a PIN within this benefit year should be able to use
that PIN. If you have forgotten your PIN, you may request a reset from the
Call Center or by going on line at the web site.
GENERAL INFORMATION TO ASSIST YOU IN ANSWERING U/C QUESTIONS
A. Wages: You must report hours worked and earnings for the week in which
you are filing. If you have worked during the week for any employer except
GM, you must report the total amount earned before deductions, regardless of
whether you have or have not been paid.
B. FOR NEW CLAIMS ONLY: During the layoff for the State weeks ending June
11, 18 and 25, if you had income that is from the Federal Government, the military,
or from out of state during the period January 1, 2004, through January 1,
2005, you must contact the Call Center and request that the earnings be used
in the calculation of your benefits.
C. REPORTING OF NON-GM INCOME. For those of you who are receiving Social Security
payments, these earnings are not considered income under State U/C. Therefore,
DO NOT REPORT THESE BENEFITS AS EARNINGS. Members who own a business or work
for another employer may be subject to having to report this information (earnings)
to the State. These are handled on an individual basis and you will need to
contact the State at the Call Center, 405-525-1500.
D. Holiday Pay: If you will be paid holiday pay for any day during the week
for which you are filing, you must report the holiday pay as wages. You must
report the total amount of holiday pay before deductions.
E. Vacation Pay: If you will be receiving vacation pay for any day(s) during
the week for which you are filing, you must report the total amount, before
deductions, for which you will be paid. Mass claimants have a definite return
to work date, so Vacation Pay is deductible.
F. Bonus Pay.
1. If you receive a Suggestion Award during any week while on layoff, you
will report it as a Bonus Payment.
Note: AutoSUB will not process in this situation. A paper SUB Application will
need to be completed and mailed to: GM Benefits & Services Center, Attn:
Layoff, P.O. Box 5078, Southfield, MI 48086, or you may fax to 313-230-7492,
Attn: Rod. SUB Applications are available in the in-plant UAW Benefits office
or the Local Union Hall. You can also print a form from the website, www.layoffbenefits.com.
Filing a paper application will normally result in a one-week delay in receiving
your SUB check due to mail time. For GM weeks ending June 12, 19 and 26, no
Suggestion Awards will be paid, therefore, this should not be an issue.
G. Jury Duty Pay. Does not count against U/C, therefore, if you are called
for Jury Duty during a layoff week, still continue to call in your weekly claim.
H. EARNINGS IN EXCESS OF $100 WILL REDUCE STATE U/C DOLLAR-FOR-DOLLAR.
Most members will open a new U/C claim in June 2005. It will be good until
June of 2006. Effective January 2, 2005, new claims will generate a maximum
weekly benefit of $292.00, with a total maximum benefit of $6,200, if otherwise
eligible. If you receive the maximum, it would be 21.23 weeks.
If you returned from leave and are laid off for part of a week, you may be
entitled to a U/C benefit. Contact UAW Benefit Representative Mike Hadlock
at 733-6657.
UNEMPLOYMENT BENEFITS ARE TAXABLE!
Unemployment Insurance benefits are subject to federal and state income taxes.
Any Unemployment Insurance benefits you receive are fully taxable. You will
be mailed a Form 1099G by January 31 of each year telling you the amount of
benefits you were paid during the previous year. This notice will be mailed
to the last address of record. The Internal Revenue Service will be given this
same information.
You may elect to have federal and state taxes withheld from your Unemployment
Insurance check. The amount deducted from your Weekly Benefit Amount will be
10% for federal and 3% for state. Once you have elected to have taxes withheld
or have declined the option, you will be given this opportunity to change this
decision only once. If you choose to change your election after taxes have
been withheld, reimbursement cannot be made for past deductions.
CLAIMS INTRODUCTION
SPECIAL NOTE: If a question tells you to report the “gross amount”,
the definition of “gross” is the amount received before any deductions
(taxes, PSP, recovery for any monies owed, etc.).
The IVR System will follow a script and ask you specific questions. Additional
questions may be asked based on your answers. Example of script and questions

SUBenefit INFORMATION
WE ARE AN AutoSUB PLANT. DO NOT FILE FOR SUBenefits ON THE INTERNET.
Some members have already served a waiting week, therefore AutoSUB will be
as normal.
These down weeks will generate a waiting period for most of our members. AutoSUB
will generate a benefit payment when a State U/C benefit has been paid or a
waiting week served. The 2003 SUB Plan now will pay all waiting weeks.
AutoSUB will not process in the following situations: Ineligibility for State
U/C (monetary ineligibility, profit sharing payments, suggestion award payments,
or excessive earnings), outside earnings, or work for GM on Sunday, June
5, 2005.
In these cases, a paper SUB Application must be completed and mailed to: GM
Benefits & Services Center, Attn: Layoff, P.O. Box 5078, Southfield, MI
48086, or you may fax to 313-230-7492, Attn: Rod. The application must be accompanied
by a copy of the document sent to you by the State that establishes your ineligibility
for State U/C (monetary ineligibility or excessive earnings). SUB applications
are available in the in-plant UAW Benefits office before the week of layoff.
You can also print a form from the website, www.layoffbenefits.com. DO NOT
FILE FOR SUBenefits ONLINE. IT MUST BE COMPLETED AND MAILED AS OUTLINED ABOVE.
Filing a paper application will normally result in a one-week delay in receiving
your SUB check due to mail time.
Dependent Information Change Form (Formerly SUB 1-HC Form)
If you and your spouse work for GM and one or both of you are placed on layoff,
you may need to complete a new Dependent Information Change Form to indicate
how your Federal Income Tax dependent exemptions are to be divided among the
two of you prior to applying for SUBenefits. You and your spouse may not claim
the same dependents if laid off at the same time. Failure to complete the Dependent
Information Change Form may result in a SUB overpayment. Your Dependent Information
Change Form remains on file for one year. If you have had a change in your
marital status or had any dependent changes since the last time you filed SUB,
you will need to complete this Dependent Information Change Form.
Normally we receive the State tape on Tuesday morning, AutoSUB will run on
Wednesday night, with mailing of SUB checks on Friday. If you file for State
U/C after 9:00 p.m. on Monday, your SUB payment will not be processed until
the next week. On Fridays you may contact the GM Benefits & Services Center,
1-800-489-4646, to verify the mailing of your check. It is not possible to
report a lost/missing SUB check until ten (10) business days after the mailing
date. EXAMPLE: Check mailed on 6/17/05 cannot be reported lost/missing until
7/5/05 due to the July 4th holiday. Check mailed on 6/24/05 cannot be reported
lost/missing until 7/12/05. Check mailed on 7/1/05 cannot be reported lost/missing
until 7-19-05.
PLEASE DO NOT CONTACT THE GM BENEFITS & SERVICES CENTER, GM OR YOUR BENEFIT
REPRESENTATIVE CONCERNING NOT RECEIVING A SUB CHECK UNTIL TEN (10) BUSINESS
DAYS AFTER THE MAILING DATE. Checks are delivered by the U.S. Postal Service
depending on your address. Yes, some lucky members may receive their SUB checks
on Saturday – you cannot depend on that!
REMEMBER: DO NOT CALL GM BENEFITS & SERVICES CENTER IF YOU ARE RECEIVING
U/C BENEFITS FROM THE STATE. AutoSUB WILL GENERATE YOUR SUB PAYMENT IF THE
WEEK IS PAYABLE.
GENERAL INFORMATION
The Medical Department will be open as follows:
June 6-10, 5 a.m. to 10 p.m.
June 13-24, 24 hours a day, Monday through Friday each week
Weekends: Third shift coverage only on Sundays
Members returning to work from a leave of absence during the down time must
clear through the Medical Department. If you do not clear through Medical,
you will not be placed on layoff for the down time and will, therefore, not
be eligible for State U/C or SUBenefits. If your leave expires during the down
time, i.e. your doctor releases you to return to work, you must report to the
GM Medical Department, and if cleared, report to the Plant Personnel Office
so you can receive instructions. Also, contact Mike Hadlock, UAW Benefit Representative.
If you do not follow the above instructions, you will probably lose or cause
a delay in all or some of your benefits, i.e. State U/C and/or UAW/GM SUBenefits.
Laid-off employees that have payroll deductions to Tinker Credit Union and/or
GMAC are responsible for these obligations for the down week.
Due to the nature of this shutdown, Management is not allowing Benefit Representatives
to work during the first week, therefore the UAW Benefit office will not
be open the week of June 6-10.
The UAW Benefit office will be open the weeks of June 13-17 and June 20-24.
The hours will be 9:00 a.m. to 5:30 p.m.
Mike Hadlock will work all three weeks, 6:30 a.m. to 3:00 p.m., mainly to
take care of AutoSUB, U/C problems, and retirements.
HEALTH CARE
There will not be a break in any health care, dental or life insurance coverage
during this down time.
Method of Collection for Contributions for Life Insurance and/or
Personal Accident Coverage While on Layoff
The required contributions for Basic Life, Optional Life, Dependent Life,
and/or Personal Accident will be automatically deducted directly from your
Supplemental Unemployment Benefits (SUB). This process will eliminate the need
to send personal checks to continue insurance coverages while on layoff. However,
if for any reason deductions cannot be collected directly from your SUB check,
a bill will be sent to you at your address of record.
If you have questions concerning this process or your life insurance coverage,
please contact the GM Benefits and Services Center at 1-800-489-4646. Questions
concerning your SUBenefits should be directed to the same Center, 1-800-489-4646.
WORK FAMILY/EMPLOYEE ASSISTANCE PROGRAM
Call 733-6386 and leave a message, or following instructions on the recorder.
Q. What services are available?
A. Through the Work Family/EAP office, referrals will be made for employees
and laid-off employees, their families and dependents, for any problems relating
to emotional, marital, family, alcohol and drugs, financial, or other problems.
All referrals are confidential and most of the time initial referrals are
free or based on ability to pay. All members are entitled to use the Work
Family/EAP Program.
Q. How do I apply?
A. You can call direct to the Work Family/EAP office 24 hours a day at the
number above.
Q. Any fee:
A. If the Work Family/EAP makes a referral to an outside service, that’s
where your financial responsibility takes over. However, we work as the client’s
advocate to make a referral that takes into account the client’s health
insurance, ability to pay, and all other relevant factors. We can also find
the good, cheap and sometimes free resources that are available in your community.
ATTENTION: Traditional Insurance Members
If you are in need of mental health counseling for yourself or a family member,
or if you or family members are in need of substance abuse treatment, contact
your Work Family/EAP Representative at 733-6386. DO NOT USE your Traditional
Directory or a United Healthcare provider. These claims are paid by Connecticut
General Insurance Company and you must use one of the panel providers approved
by them or call the CDR at 691-1417.
ATTENTION: Pacificare HMO Members
You may also request mental health counseling for yourself or a family member,
or substance abuse treatment services directly from your Primary Care Physician,
or call your Work Family/EAP Representative to help in making a referral.

the layoff, it is recommended you try to resolve any problems you may have
